Terms of Service

These Terms of Service (“Terms”) are an agreement between you and [Registered legal entity name] (BEAMS Clinic) (“we”, “us”, “our”). They govern your access to beamsclinic.com and the services connected to TikTok (the “Services”). Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to these Terms.

1. Definitions

  • TikTok Account means your TikTok user account or advertising account (Ad Account) that you are authorized to use.
  • Marketing API means the TikTok API set used to manage and view advertising data.
  • Organic API & Research means the TikTok API set used to view organic account and content data, including research data.

2. Scope of Services

The Services allow authorized users to view and analyze the following data through our dashboard:

  • Advertising campaign performance data from ad accounts you authorize (Marketing API).
  • Profile, follower, and video engagement statistics from accounts you authorize (Organic API & Research).

The Services do not post, edit, delete, or publish any content on your TikTok Account unless you expressly request such an action and perform it yourself.

3. Eligibility

  • You must be at least 18 years old, or have the consent of a parent or legal guardian.
  • You must have the legal right to connect and view the data of any TikTok Account you use with the Services.

4. Connecting Your TikTok Account

  1. Connections are made through TikTok Login. You will see the list of requested permissions before you approve them.
  2. We access only the data you authorize. We never ask for or store your TikTok password.
  3. You may disconnect at any time via TikTok → Settings and privacy → Security → Manage app permissions.

5. Your Responsibilities

  • Use the Services only for lawful business and analytical purposes.
  • Keep your login credentials confidential and take responsibility for all activity under your account.
  • Do not attempt to access data of other users without authorization, and do not modify, reverse engineer, or attack the Services.
  • Do not use data obtained through the Services for discrimination, fraud, harassment, or violation of any person’s privacy rights.
  • Comply with the TikTok Terms of Service and the TikTok Developer Terms at all times while using the Services.

6. Use of TikTok Data

Data obtained through the TikTok APIs belongs to the relevant TikTok Account holder and is subject to TikTok’s terms. We use such data solely to provide the Services as described in our Privacy Policy, and we will not sell, rent, or disclose it to third parties for other purposes.

7. Intellectual Property

All content, design, software, logos, and trademarks on the Services are owned by us or our licensors. You may not copy, modify, or distribute them without our prior written permission. TikTok is a trademark of TikTok and/or its affiliates.

8. Accuracy of Information

Data displayed on the dashboard is sourced from TikTok and may be delayed or inaccurate depending on the upstream provider. It is provided for informational purposes to support your decisions. It does not constitute financial, investment, or medical advice.

9. Availability and Suspension

We strive to keep the Services available, but we do not guarantee uninterrupted or error-free operation. We may suspend or discontinue all or part of the Services, or revoke your access, if you violate these Terms or the TikTok terms. Where practical, we will give advance notice.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages, or any loss of profits, arising from your use of or inability to use the Services, including business decisions made in reliance on dashboard data.

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms, the TikTok terms, or applicable law.

12. Changes to These Terms

We may update these Terms from time to time and will indicate the latest update date on this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand. The courts of Thailand shall have jurisdiction over any disputes arising from these Terms.
